>> the president unvails a tax plan. >> we have suffer ronder rendered our competitive edge to other countries but are not surrendering anymore. >> reporter: democrats say the real winners of his plan are the rich. >> reporter: and the landlord of oakland's notorious warehouse enters a plea. why he says he's not guilty in the fire that left 36 people dead. the four on two starts now. the bay area's busiest freeway remains closed in the westbound direction this afternoon after a deadly officer-involved shooting left the morning commute at a standstill. now, we're just getting word the highway patrol says the freeway in the westbound direction in both directions could be open by 5:00 n. in just about an hour. here is a live view from sky fox overhead. you can see heavy traffic heading eastbound. no traffic heading westbound. police are still investigating the shooting scene, and that is why part of interstate 80 in

emoryville is closed. welcome to the 4 on 2. >> hello, everyone. i'm heather holmes. police say they spotted the man wanted for a homicide and tried to pull him over. that is when the chase began and ended on westbound. >> rob, i understand you are on the freeway to tell us what is going on. >> that's right. we're on interstate 80 now, all this happened after the police car chase and shoot-out that began in richmond this morning. the stand-off happened following a pursuit on interstate 80 eastbound just past the exit shortly before 9:00 a.m.

they say ever say he was holding a gun. one witness says she saw what happened. >> they told the guy to get out of the car and he wouldn't get out. it was at least about 20 minutes. >> they fired nonlethal weapons but the suspect didn't surrender. the driver got out of the car and began firing. one heard 50 gunshots. >> they shot one and he stuck his hands out. this time, he got out and he pointed the gun and shot him. the police shot him dead. >> this took quite a while to negotiate. unfortunately, the suspect started to produce a firearm and started shooting at the officer. >> authorities say earlier this morning, fairfield police learned the ma man was in richmond and asked police to pick him up.

they say the man then fled in his car. the california highway patrol layed down spike trips and that stopped a car leading to the stand-off and shoot-out. authorities closed heavily congested interstate 80 in both directions as they collected evidence making an already difficult commute a disaster eastbound and westbound. >> i was there for about two hours. it was pretty crazy. we got out the cars. it was that crazy. it wasn't moving at all. everybody was outside their cars. everybody was mad. >> now, i-80 eastbound was reopened in about 11:00 this morning, but westbound remains closed. now, one of the reasons that westbound has been closed so long is that we are told that some of the crime scene investigator loss had to come here were caught in the traffic and it took them a long time to get here. that is why we are in the situation we're in. now, police -- they're the ones that are going to be investigating the stand-off and

shoot-out, and they say they are going to look closely to see who fired shots first. >> these days, heavy traffic exists in both directions during the commute. in the afternoon, it's going to be mostly in the eastbound side. i can see behind you, it looks like traffic is just creeping along. is that because you think motorists are totaling down the crime scene. >> i think there is some of that. it's just been like this all day long. the residual of it being closed plus add-on the heavier traffic that we get on a daily basis. thes just your basic mess only this time, it is a bigger mess. >> and yeah, it certainly is. it took me two and a half hours to get from santa rosa here in the studios today in oakland. obviously getting caught up in that. again, as rob just told us expecting to be open in about an hour. thank you. and working to learn more about the suspect involved in today's shooting. we'll bring you that story coming up in our later newscast. well, another rally by the

patriot prayer group at u.c. berkeley today was disrupted when a call came in about a suspicious package there. as police i sack waited part of the plaza as well as the mlk student union at about 12:45 this afternoon for the investigation. the bomb squad determined that there was no threat and the -- reopened about an hour later. there continues to be a large police presence on campus. this is the second rally by the conservative group despite the cancellation of so-called free speech week that was supposed to feature right wing speakers. crews in san francisco attacked three separate small grass fires and the district right around noon today. the fire department says the fires burned a total of three acres, and a cause is under investigation. there are no reports of any injuries. fire crews will remain on the scene to make sure there are no flair-ups. five people were a bus cras san francisco during the morning commute.

witnesses say a bus driver hit two cars and then another bus careening out of control on to a city sidewalk near folsom and freemont before smashing into a light poll. ktvu is live on the scene and she joins us again from the area at the folsom street offramp. is it all cleaned up, and how does traffic look? >> well, just about which is great news for this evening commute. the tow truck is getting ready to take the remnants of the crash away. temperature is the ac transit bus that caused the crash. you can see hower is serious this accident was when you take a look at that windshield when you see the heavy glass damage there. if we pan over to the right, you can see that this is the follow? street off ramp. this was what was shut down for two hours obviously causing a lot of back-up. back up and running right now. five people again were hurt in this accident, but luckily, all of those injuries considered nonlife threatening. the big question is what caused

this crash? just before 9:30, a green ac transit bus careened on to the sidewalk slamming into a ramp. and the driver was headed northbound on freemont street trying to make a turn when she hit three cars and clipped another transit bus. a bus full of people jumped the curb taking out bushes and poles flying over the head of the man who hit the ground. miraculously, he was not hurt. those aboard the bus bound from oakland, it was a scary moment. >> surely, the bus driver is going to slam on the breaks and we'll deal with the situation. we just sort of nowed through the intersection. then, there was kind of a moment of pause. i shouted out is everyone okay? is everyone injured? to the best of my knowledge, the passengers were okay. we started up opening sides and little window sections and we jumped out. >> now, some nearby

construction workers ran across the street to help these passengers get off the bus. we don't have an exact head count on how many passengers there were because some of them left the scene before police could get there. a video of the nearby camera shows the bus plowing through the intersection. meanwhile here at the offramp, they are about to take this bus away. that is good news for the evening commute. hopefully we won't have too bad of a traffic jam. ktvu, traffic news. >> the troubles really from unone end of the bay to the other. thank you. a six-year-old child was hit by a car right in front of his mother in richmond.

>> searching for the driver who took off. k, thevu live for us this afternoon at ucsf. at the children's hospital there in oakland with the latest on that boy's condition. >> reporter: well, heather, i can tell you that the little boy was airlifted from richmond and flown here from children's hospital oakland around noontime. at last check, he is still in critical condition and right now, his mother is by his side inside the hospital. sky fox flew over the scene of this city. shortly after it happened. richmond police say the six year-old boy was trying to get into the family's van. the boy was standing on the driver's side of the van on the street when he was hit by a red smart car. that car was traveling westbound on mcdonald aver, and witnesses tell police that the car stopped momentarily and then kept driving. >> it is tragic whenever

anyone gets hit by a vehicle and most of the time it is an accident and i just wish that people would remember that and remain on scene. it makes things more problematic when they don't. >> richmond police describe this car as a red smart car, possibly a 2008 to 2012 model, and it likely has some front end damage the right side of the car. employees at northbound businesses tell me the mother was frantic. she's crying and there was one employee that had to help translate. she had to help translate for authorities. it is unclear how severe his injuries are. they didn't go into details about where he was hit.

they did ask anyone who may have seen something or know something. >> guys. >> all right. an investigation into underway into a crash on interstate. >> the highway responded about a body on the highway near pleasant hill road in la fayette. you can see the scene here. witnesses say the woman was jogging in the eastbound direction and ran into moving traffic in the right lane. she was struck by a van. the driver of that van did stay at the scene and is cooperating with investigators. the victim's name has not yet been released. >> reporter: the alameda county bomb squad was called out what appeared to be a pipe bomb was found at a recycling center. workers at the salvage and recycling center and family have responded right there in a dumpster. the bomb squad says it has removed and disabled it. investigators are still trying to determine if it was real or fake. there is no word yet on where the device came from or how it ended up in the dumpster.

developing news out of sacramento just hours ago. governor terry brown signed legislation to move up california's presidential primary in 2020 by three months. that measure aims to get california which is, of course, the nation's most populated more sway in chosing the republican and democratic nominees. california distributes the most delicates in the -- delegates in the nominating process. crews are working to insure a fire in the oakland hills doesn't flair back up amid the hot and dry weather outside. >> plus, the work to send aide to puerto rico is ongoing. the push by some members of congress to speed up the supply them and -- then and getting stranded people out. >> and in weather, temperatures soaring today across the entire bay area, but some changes developing offshore. there is a fog bank that could impact our weather forecast. we'll have more on that for tomorrow, and some bigger changes in your five-day.

some members of congress are calling to waive an act. >> the latest now from puerto rico. >> most of puerto rico still has no power, water, food or gas. president trump says more help is on the way and relief efforts are ongoing. >> puerto rico is a difficult situation. that place was just destroyed. that is not a question of gee, let's dry up the water. let's do this or that.

that place was flat. that is a really tough situation. >> reporter: acting homeland security secretary says the federal government is trying to restore communications by working with cell known companies and increasing distribution of aid across the ravaged island. >> we are attacking the areas of the diminished capacity. so there is food and water on the island. there were is gasoline on the island. we have asked defense logistics agency to august meant the local national guard and distribution channels that we can get goods and gasoline out more quickly. >> dozens of ships and military personnel to puerto rico. the navy and marines are moving supplies to help with the humanitarian effort. the people on the island say the help isn't getting there soon enough. >> everybody is dying of hunger. >> one day at a time. >> the dallas mavericks

there. still fire danger especially this time of year always a big concern especially as we change the page to october in just a few days. outside, loftiest ever clear skies out toward san francisco bay. and the headline, you can see it for your thursday. we begin to cool things off for tomorrow especially near the coast and portions of the bay. inland still another hot day, but those temperatures are flirting 90 did glees. on the satellite, you see what is happening. we have a storm in the pacific. that is moving way up to our north. there is that fog bank offshore. we traced in the surface wind as well. the winds are key, because as you can pick out, we have a little bit of a northerly wind prevending the -- preventing the fog bank w. that, that is strengthening. we're going to cool things off coastside and near portions of the bay tomorrow. today, though, still hot. right now, we have temperatures in san francisco at 78. lower 20s out toward concord and fairfield and santa rosa at

defense attorneys again question why building owner troy ing hasn't been charged with a crime. >> the prosecution has cheesen to indict at a charge two young men who are artists, who are poor, who have no money, trying to hang responsibility over what was a deficient structure, trying to hang that on matt harris. >> a preliminary hearing is set for november 13 sergeant. that is whether alameda county prosecutors will begin outlining their case against the two men. at the end of that hearing, the judge will determine if there is enough evidence for a trial. for more, i am joined by michael cardoda. lot to talk about. and just the fact of putting these two men convicted on involuntary manslaughter. and i am not sure it is in a case like this. i think the defense attorney shop. and to take the emotion out of

this case and to approach the facts more surgically. we have seen what the inside of that house looked like. we have pallets for stairs on and on. when you look at that, you go my lord, hoddled you let people go in there. the defense attorney's job try to ratchet back that emotion. >> a lot of people were aware of the conditions in there prior to this fire. we had the oakland police. we have camera footage from an officer being there years ago. there were complaints about this in place for a long time. so shouldn't some other people bear some responsibility as bell. >> certainly, they should bear some responsibility, but it's the old government inimmunity. we can't have everybody suing the government. if the government overlooks something or makes a mistake, we don't let our citizens sue them. thes going to somebody than just a mistake. are they partially irresponsible? absolutely.

criminal, no, they're not. >> what about the contention that the building's owner should be facing charges? >> i am onboard with that. i think the defense attorneys so far are doing a good job, but you point to the building owner and say what about them? well, that is all nice, but, you know, i put my va hat on now and go that's night. we'll get to them. right now, we're looking at you. and so they will focus the jury and. they'll focus not the jury, but the judge. we have you now. let's deal with you. don't be pointing to them right now. you'll probably to to ask the district attorney. daughter is here. why don't you go after her. that's a question only she can answer. >> but to the two men. i mean, it all circlesishment they have been there a long

time. they are running the show that have people coming in and out. you describe the electrical system and on and on and on. it is clear it was a very unsafe situation. these two men, it seems like the district attorney is going to lay out a case and make it clear that they have responsibility. >> i would imagine it's called turning a blind eye. you see all this. you see the crowd of people out there that are paying x amount of dollars. had i had taken his family. not withstanding, hallian that building. harris happened to be there that night. >> and he was at the door, so he did get out alive. laugh do you do? do you blame these two? that is going to be the big question. my personal opinion? yeah, you do blame them because it's like hey, you guys are running this. you knew what it was like, and if a fire broke out, you should have thought of that so you are responsible. but what punishment will the

judge meet out if they are convicted. involuntary manslaughter. it's a try-out of two, three, or four years. that's not going to happen. won't happen. so i believe if they do get convicted, it will be like four counts and three years. they'll serve 12 years. they'll serve half of that which is six. that is what i see happening awith this. they may well dispose of the case by pretrial negotiations. the defense may say give us less than six. we'll take it. >> we'll keep an eye on the case as we keep moving forward on all of this. san francisco may delay the sale of recreation that marijuana. why the city won't issue permits to shop. >> we're here from the medicinal marijuana dispensaries. recreational dispense -- it's

unlikely we'll see any opening here in san francisco or many other around the state right away. california voted in favor of legalizing recreational marijuana last year. permits to sell it will be issued in the rest of the state starting in january. but cities and counties including san francisco are waiting for state regulators to lead the way. part of san francisco is looking for regulation that would help low income people and people of color break into the cannibus industry. san francisco will require all dispensaries to keep selling medicinal marijuana if their primary business is to sell for recreational use. and the city is also looking at working out details for a new licensing system to bring current medicinal marijuana dispensaries in line with a new state law. experts say come january 1, we likely won't see the immediate boom in business such as we saw in colorado and other states that legalized recreational marijuana. >> we're not going to -- going to have a similar thunderclap heard across the state on january 1 social security in 2018. it's going to be a real slow walk to full commercial

recreational sales here in california as cities and counties decide exactly how they want to implement the flaw. >> reporter: here in san francisco, supervisors are expecting a report from the office of cannibus ontic inquirity -- equity november social security. supervisors will vote on new legislation sometime after november 14 sergeant. ktvu, fox2 news. oakland mayor is now releasing more details about her plan to help the homeless. she announced plan to open a new navigation navigation series. now she's elaborating. the site would move homeless people into temporary shelter as they wait for permanant housing. the first of three possible outdoor navigation centers would provide 40 people temporary tough shed living structures for up to six months. portable toilets, showers, and onsight social services. the city council will have four locations to chose from when the plan is presendedded to the

president trump unvailed his plan. inform his speech, the president said this plan would bring revolutionary change that would help the middle class. fox reporter is in washington now with details of the proposal. >> the president selling his tax plan calling it the largest tax cut in essentially the history of the country. >> we have surrendered our competitive edge to other quivererty -- countries, but we are not surrendering anymore. >> reporter: the president traveling to indiana laying out the framework of a new tax plan together by congressional members and the white house. >> under our framework, we will dramatically cut the business tax rate so that american companies and american workers can beat our foreign competitors and start winning again. >> republicans say their plan lowers rates for individuals and families, doubles the standard deduction, essentially doubling the amount of personal income that is tax-free and

eliminates loopholes. the gop says it also repeals what they call the depth tax and alternative minimum tax and changes tax rates for small businesses and corporations. president trump insists wealthy americans would not benefit under his tax plan. and the only thing he is firm on is cutting the corporate tax rate to 20%. passing savorings on to the middle class. hundreds of billions of taxbreaks to the wealthiest people in most profitable corporations. democratic senator is calling the plan welfare saying it would add five to seven federal dollars to the deficit and ultimately put programs on the chopping block. >> and medicare and social security. >> and and provided a republican party. it leaves many key details up to congress to figure out

including how to pay for it. in washington, lauren blanchard, fox news. >> for more on the republican's tax reform plan. what do you think of the framework? >> it doesn't add a lot more to what we already knew for the last year or so with the house republican blueprint laying out a framework with president trump laying out a framework in april. not many more details that we had beyond what we had a few months earlier. >> do you think that we have enough details now to know just who will actually benefit. >> some of the details. they're going to lower the top rate from individuals from 39.6 to 35% to very high income would see a cut there. so far as what the effect would be to middle or lower income, they talk about doubling the standard reductions. they also talk habit we don't know where the rate brackets

will start and end. they have left a few open, will increase the child tax credit not saying how much they will increase and who would be able to claim that. they talk about using a different factor for adjusting brackets for inflation which would be left favorable before. until you see the pieces or details, it's hard to see how the combinations will affect individuals so far as will it truly lower or will they see perhaps little change. >> do you think this will simplify things. >> i don't seeable -- they will be getting itemized reduction. and we will see -- >> and a single individual that has claimed 12,000% and not itemize. the only itemize deduction will be contributions. but for some individuals,

they'll find a standard deduction will be charger than their larger u. >> a lot focuses on corporate tax rate. president obama and during his pregnant nasi. they, too, supported a lower tax rate. they also failed to pass tax reform. what are the obstacles to getting this done? >> and looking at the actual details. and there needs to be a better understanding how lower rates operating in this international competitive environment. that is more similar to what other countries do. our corporate tax rate is higher than other countries, so dropping it from a top of 35% corporate rate to a maximum 20% does make it more in line with other industrial xized countries and that will be help to businesses that are

competing with other companies. >> we know this plan faces stiff. this provides tax cuts to the rich. are the democrats right to fight this plan? >> well, one thing they do know in the plan that came off the bay is thaw would like to see bipartisan activity. they would like for it to be bipartisan because it will be easier to pass lasting tax reform as to posed to doing it under what is called budget reconciliation which then might be only a ten-year plan. so i think they are seriously wanting to see more interaction. i think you will see that among the democrats, they do want to make our tax system more internationally competitive. but not to see large deficits left behind. large deficits end up being tax increases ifer your children or your grandchildren. >> and thank you splotch for your expertise. i guess -- so much for your

expertise. we'll have to find out we have more details. >> thank you. you're welcome. the department of homeland security quietly unvailed a new rule directing employees to collect social media information on all immigrants including permanant residence and natural xized citizens. the new rule applies to visa applicants as well as people who have already obtained a green card. we spoke to the santa clara university law prophesier who says he expects the rule to also affect any u.s. citizen who communicates with immigrants on social media. >> >> even if you are a natural born citizen. other people who are born with your communication are going to be positively known to vhs, and those communications that you previously thought were private correspondents. >> the rule is supposed to go into effect october 18th, but civil liberties experts say it will face a legal challenge. boy, it has been a hot button issue recently in santa

clara. should concerts there at levi stadium be allowed to go past 10:00 at night. well, now people living near the stadium will get to weigh in on the hotly contested battle over that curfew. and weather has been hot across portions of the bay area. close to 90 degrees even in san francisco. those temperatures zooming back up into the 80s. coming up, we're going to cool things off for parts of the area tomorrow and some bigger changes developing not your five-day forecast.

people living near levi can get their opinion of allowing concerts to go a little bit longer. >> the details on the community outreach effort. the city council is planning. people who live within a one-mile radius can expect to get a packet in the mail from santa clara city leaders asking for their opinion of what they think about the weeknight curfew for concerts at this stadium. right now, the weeknight curfew is 10:00. that have is when the last song can be played. the 49ers which managed the stadium say that curfew hurts their ability to attract big musical acts. they set the example of grammy- winning singer ed sheeran. he was scheduled to perform next year. that concert was canceled because of the 10:00 curfew. his representatives apparently said there was no way he could finish his concert in time.

now, at santa clara city council meeting that went on past midnight. they needed to hear more of the community. phone surveys, written surveys, focus groups. to see if the reactions change. the city's reaction outreach claims they will consider speaking with residents in north santa fe and talking to their city governments to get their reaction to the idea of that curfew extension as well. in santa clara, ktvu, fox 2 news. checking not now with our meteorologist. i'm glad to hear that things are going to cool off tomorrow. >> we'll begin to shave off and more pronounced cooling as we head towards friday and the weekend.

still fire danger this time of year. things have dried up so much over the fast fewness. santa rosa, 90 degrees. san jose,th 1. and most areas around 80 to 90-degree's for your wednesday afternoon. and here is the bigger view out here in the pacific. you can see just offshore, there is actually a bit of a fog bank trying to develop. we are kind of battling and tracking to battling wind directions here. we have a northerly wind that is stepping up out here. this actually prevents the fog from moving in. we have more of an onshore breeze that is cooling off the coast and near portions of the bay. forecast models showing not fog bank inching a bit closer our coastline for tomorrow. here is our live camera looking out toward. if just a few high clouds out there in the distance, and once again, tomorrow, we will begin to cool things off compared to

hour. temperatures will be approaching the 70s. this area of high pressure has been in charge of our weather strengthening over the past few days since about monday. this begins to weaken for tomorrow. as we talked about the fog at least an onshore breeze will cool things off coastside. still near 90 inland for tomorrow. as we head into friday and beyond, we're tracking not cooler weather system. so a bit of a slide in temperatures for friday and into saturday. our next warming trend not going to move back into the area e. it's not until next week, and that could be by monday. here is a forecast model showing you this and it is trying to bring some patchy fog near portions of the coastline. this is 8:00 tomorrow morning. and here we go with that red contour. warmest locations around 89 to 92. that is all reflected in the highs tomorrow. santa rosa, 89. oakland 816789 livermoore 91. not a big changed for the inland temperatures tomorrow. san jose in the upper 8 0s. the coast in the upper 60s to 70s. it looks like a stretch of nice beach days could be coming to

as clean-up efforts continue in houston, a new problematic issue has now surfaced. that's how to get rid of all the mountains of trash left behind by hurricane harvey. 125 football fields could be filled with all of that debris. long lines are reported at landfills and the texas commission on environmental quality set up 166 special debris management sites inside the disaster zone. other cities have sent staff and trucks to help lend a hand. dallas, san antonio and austin have all sent workers and trucks and independent contractors are also working nonstop. meantime, as many as 360 buildings and homes had major damage and are in danger of collapse almost a week after the 7.1 earthquake rocked mexico city. jonathan hunt reports with the latest on the recovery efforts. >> reporter: in a televised address to the nation, mexican president enrique pena nieto said search-and-rescue operations like this one will

go on until every, single missing person has been accounted for. in the meantime, thousands of buildings across mexico city suffered damage as a result of the quake. they need to be checked before anybody is allowed back into them. teams from the u.s. are doing a lot of that work. i spoke to chief dennis kroft one of the team leaders earlier today. >> one of the great things the u.s. a2 team brings is structural engineers. they are valuable. they provide us the well-being and the knowledge that if we're going to enter a structure, they have assessed it and determined it's safe for us to effect a rescue. >> reporter: chief cross also paid tribute to the way the mexican government has organized an international operation here. >> it makes everybody realize that it's one world, one people. when we got out of our trucks four days ago and started walking to this job site and received applause and gratitude, people hugging and kissing you, it makes you realize it's one big world and we're all in this together.
